1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the Finley Health website and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. What Finley Is — and Is Not
Finley Health operates a technology and marketing platform that connects individuals with independent, licensed healthcare providers and state-licensed pharmacies. Finley is not a medical practice, does not provide medical advice, and does not practice medicine or pharmacy. All clinical decisions are made solely by independent licensed providers exercising their own professional judgment.
3. Eligibility
You must be at least 18 years old and a resident of the United States to use the Services. By using the Services, you represent that you meet these requirements and that all information you provide is accurate and complete.
4. Medical Services and Consultations
Any prescription is issued only after an online consultation with an independent licensed provider who determines whether treatment is appropriate. Providers may decline to prescribe based on their clinical judgment. A consultation does not guarantee any particular treatment, diagnosis, or outcome. The Services are not for medical emergencies — if you have an emergency, call 911 or go to the nearest emergency room.
5. Subscriptions and Billing
Certain Services are offered on a recurring subscription basis. By enrolling, you authorise Finley and its payment processors to charge your payment method on a recurring basis until you cancel. Prices are disclosed before purchase. You may cancel at any time, effective at the end of your current billing cycle. Fees already paid are non-refundable except where required by law or expressly stated.
6. Compounded Medications
Some treatments involve compounded medications prepared by state-licensed compounding pharmacies. Compounded medications are not approved by the FDA and have not been evaluated by the FDA for safety, efficacy, or quality. They are prepared pursuant to a valid prescription for an individual patient.
7. Your Responsibilities
You agree to provide accurate health and personal information, to use medications only as directed by your provider, and not to share your medications with others. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
8. Intellectual Property
All content on the Finley website — including text, graphics, logos, and design — is owned by or licensed to Finley Health and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
9. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Finley does not warrant that the Services will be uninterrupted, error-free, or secure. Individual results from any treatment may vary.
10. Limitation of Liability
To the maximum extent permitted by law, Finley Health and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services. Finley’s total liability for any claim relating to the Services shall not exceed the amount you paid to Finley in the three months preceding the claim. Nothing in these Terms limits liability for clinical care, which rests with the independent licensed providers.
11. Indemnification
You agree to indemnify and hold harmless Finley Health and its affiliates from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or by prominent notice on our website. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the United States and the state in which Finley Health is incorporated, without regard to conflict of laws principles. Specific jurisdiction details will be updated upon completion of our corporate registration.
